Terms of Service: Ninety8 Product Compliance
Last updated: 1 November 2026
These terms apply when you use Ninety8 Product Compliance at app.ninety8compliance.com (the "App"). Please read them before you sign up. By creating an account or subscribing, you agree to them on behalf of yourself and the business you represent.
1. Who we are
The App is provided by Ninety Eight Technova Limited, trading as Ninety8 Compliance, a company registered in Ireland (company no. 820476), with its registered office at Woodfield, Tuam, Co. Galway, H54 DK22 ("we", "us", "our"). Contact: hello@ninety8compliance.com.
2. Business use only
The App is for businesses that make, import, distribute or sell products. You confirm that you are using it in the course of your business and not as a consumer.
3. What the App does
The App helps you work out which EU rules apply to your products, collect documents from your suppliers, check those documents against fixed checklists, and prepare compliance files, declarations and related records.
The App gives guidance, not legal advice. A result of "Accepted" means a document met our checklist when it was checked. It is not a certification, approval or guarantee that a product complies with the law or may be placed on the market. Checks are based on the documents and answers you provide, and some steps use automated (AI) processing.
You remain responsible for your products and for your legal duties as a manufacturer, importer, distributor or other economic operator. This includes reviewing and signing any declaration of conformity yourself, and having translations checked by a fluent speaker before you rely on them.
4. Your account
- Keep your sign-in details safe and tell us at once if you think someone else has used your account.
- The account owner can invite team members, up to the number of users included in the plan. The owner is responsible for what team members do in the account.
- Give us accurate details, including your company name and address, because they appear on documents the App produces.
5. Plans, prices and payment
- Free plan: limited features, with no payment needed. We may change what the free plan includes.
- Paid monthly plans (Starter, Growth, Pro): billed monthly in advance by card through Stripe, and renew automatically until cancelled. Current prices and limits are shown on the plans page in the App.
- Enterprise: billed annually by invoice on the terms set out in your quote. Invoices are payable within 30 days unless the quote says otherwise.
- All prices exclude VAT, which is added where it applies.
- We will give you at least 30 days' notice by email of any price increase. It takes effect from your next renewal after the notice period.
- If a payment fails, we may move your account to the free plan. Your files stay available read-only, as described in section 9.
6. Cancelling and changing plans
- You can cancel at any time from the billing page. Your plan continues until the end of the period you have paid for, and is not renewed after that.
- We do not give refunds for part-used periods, except where the law requires it.
- You can change plan at any time from the billing page. A move to a higher plan takes effect straight away, and you pay the difference for the rest of the current period. A move to a lower plan takes effect at your next renewal. If you are over the lower plan's limits, you will not be able to add more products or users until you are back within them.
7. Your content
- You own the product information, documents and records you or your suppliers put in the App ("Your Content").
- You give us permission to store, process and copy Your Content only as needed to run the App for you, including sending it to our service providers for processing as described in our Privacy Policy.
- You confirm that you have the right to upload Your Content and to ask your suppliers to upload documents to your account.
- We act as your data processor for any personal data in Your Content. A data processing agreement is available on request.
8. Acceptable use
You must not:
- upload anything unlawful, harmful or that you have no right to share;
- use the App or its outputs to mislead authorities, customers or marketplaces, for example by presenting a check as a certification;
- try to access other customers' data, interfere with the App's security, or overload it;
- copy, resell or reverse-engineer the App, its checklists or its rules data; or
- share your sign-in details outside your team.
We may suspend an account that breaks these rules. We will tell you why, unless the law or a security risk prevents it.
9. When a plan ends
- If your paid plan ends, your technical files, declarations and records stay viewable and downloadable for at least 12 months. Editing needs an active Growth, Pro or Enterprise plan.
- After that period we may delete Your Content, but never without emailing the account owner at least 30 days beforehand so that you can download it.
- You can ask us to close your account and delete Your Content at any time.
10. Availability and changes to the App
We aim to keep the App available and up to date, but we do not promise it will be uninterrupted or error-free. EU rules and harmonised standards change, and we update the App's rules data regularly, but there may be a delay before a change is reflected. We may improve or change features. If we remove a major feature from your paid plan, we will tell you in advance, and you may cancel.
11. Our intellectual property
The App, its software, checklists, rules data, templates and branding belong to us or our licensors. Documents the App produces for you, such as declarations, file indexes and filled templates, are yours to use for your own business.
12. Liability
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
- We are not liable for loss of profit, revenue, business or goodwill, or for any indirect or consequential loss.
- We are not liable for losses that result from the content of documents supplied by you or your suppliers, from your products, or from decisions you make about placing products on the market.
- Otherwise, our total liability to you in any 12-month period is limited to the fees you paid us for the App in that period.
13. Ending these terms
You can stop using the App at any time. We can end these terms by giving you 30 days' notice, or at once if you seriously break them or fail to pay. Sections 3, 7, 9, 11, 12 and 15 continue to apply after the terms end.
14. Changes to these terms
We may update these terms. We will email account owners about significant changes at least 30 days before they take effect. If you keep using the App after that, the new terms apply. If you do not agree, you can cancel before they take effect.
15. Law and disputes
These terms are governed by the law of Ireland, and the courts of Ireland have exclusive jurisdiction. Before going to court, please contact us, and we will try to resolve the matter with you directly.
